1. Introduction

You may be aware that a new European Union law, called the General Data Protection Regulation or "GDPR" gives certain rights to individuals in relation to their personal data. Accordingly, we have implemented additional transparency and controls to help users take advantage of those rights. In order to enable you to exercise these rights with ease and to record your preferences in relation to how we use your personal information, we have updated our Privacy Policy effective May 25, 2018.

Merriman Market Analyst wants you to be familiar with how we collect, use and disclose information from and about you because we respect your concerns and choices about privacy, and we want to maintain your trust. By visiting this web site (“Site”) or using any of the services offered on the Site, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone. We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g., to ship an order or provide you services. Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this Privacy Policy. 

You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number provided on the Site.

2. What We Collect

For a better experience while using the Site, or to provide you with products or services, we may ask you to provide us with certain personal information. We collect personal information when you submit it to us, such as when you register for or subscribe to certain products or services, create a profile, or contact customer service. The personal information may include your name, phone number, postal address (including billing and shipping addresses), credit or debit card number, telephone number, mobile number, and email address. The information that we collect will be used to contact or identify you.

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (e.g. billing or customer service) are granted access to personally identifiable information. 

We want to inform you that whenever you visit the Site, we may collect information that your browser sends to us that is called Log Data. This Log Data may include information such as your computer’s Internet Protocol ("IP") address, browser version, pages of our Site that you visit, the time and date of your visit, the time spent on those pages, and other statistics.

The Site contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

We value your trust in providing us your personal information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

3. How we use your personal information and other information

We use the information we collect from and about you to provide our products and services to you, including: to process and fulfill your subscription and orders, to create and manage your accounts, to send you information about your relationship or transactions with us, to provide you with customer support, and to respond to inquiries. We may use your personal information to share upcoming products, services, and events.

Merriman Market Analyst does not sell, rent, or share personal information to or with any third party not affiliated with or owned by Merriman Market Analyst. We will not give or sell your personal information to be used for the purposes of sending you unsolicited commercial offers (such as spam) from any third party.

4. How we share your personal information and other information

You may always limit the amount and type of actively-transmitted personal information that Merriman Market Analyst receives about you by choosing not to enter any personal information into forms or data fields on the Site. However, some online services can only be provided to you if you provide appropriate personal information.

We will disclose personal information when required by law, or if we have a good-faith belief that such action is necessary to (a) comply with a current judicial proceeding, a court order or legal process served on us, (b) protect and defend our rights, or (c) protect the rights, property, and other interests of our users or others.

5. How we protect and retain personal information

Merriman Market Analyst makes reasonable efforts to ensure a level of security appropriate to the risk of the processing personal information. However, no one can guarantee the complete safety of your information. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting Customer Service in accordance with the instructions below.

When registering for access to a secure area of the Site, we will ask you to select a username and password. We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also, remember to sign out of the registered site and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence when accessing your computer.

6. Your choices about how we use your personal information

We give you many choices regarding our use and disclosure of your personal information for marketing purposes. You can opt out of email marketing from Merriman Market Analyst by using the unsubscribe links provided. Please note that there are certain service notifications that you may not opt out of, such as renewal notices and notifications of changes to Merriman Market Analyst products and services or policies.

You can access, review, correct, update, delete or modify your registration or subscription profile information and modify your marketing preferences by contacting Customer Service at CustomerService@mmacycles.com. Where you have provided your consent for our use of your personal infomration, you have the right to withdraw your consent and we will apply your updated preferences going forward. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions you began prior to requesting such change or deletion.

7. Notification of Changes

Thank you for reading our Privacy Policy. We may make material changes to this Policy and when we do so, we will provide you with notice of the updates by posting a notice on our website or by sending you an email. If the Privacy Policy changes materially so that your personally identifiable information will be used in a manner different from that stated at the time of collection, we will try to contact you by e-mail to give you a choice as to whether or not we may use your information in this different manner. However, you are responsible for ensuring we have a current working email address for you. If the e-mail address you have given us is incorrect or no longer operable, we will have no further obligation to notify you apart from posting the notice on our Site.

If your personally identifiable information changes, you may contact us to correct, update or delete and deactivate our record of your personally identifiable information.

Security Policy

Your payment and personal information is always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read over the internet.

 

Delivery Policy

We ship our products via UPS, or the US Postal Service.  We ship within 48 hours of processing your order.  You will have your purchase within 7 days of your order if shipping address is within the United states, 14 days if international.  If there are any exceptions to this you will be notified. Thanks for your business.

 

Return and Refund Policy

It is our policy to offer a 30 day money back guarantee on all of our books and software (excludes eBooks). In order to obtain a refund you must notify us via email or phone within the refund period.  All products must be returned in very good condition, completely intact and in resalable condition.  Refunds will be processed within 7 days of approval and will be posted to the account that was used to purchase the item.  We do not allow refunds on any of our subscriptions, eBooks, MP4 files, or electronically delivered products.  If the subscription you purchased does not suit your needs, we will happily give you a credit for the remainder of your subscription, which you can apply to a book order or another subscription. We will not refund subscriptions under any circumstance. No refunds or credits on electronic purchases.

 

Subscription Schedules and Policies Regarding Special Reports, Updates, and Alerts

MMA Cycles Report comes out once a month and is issued at least 12 times a year.

MMA Daily Report is issued 5 days a week, for at least 12 weeks a quarter or 48 weeks a year. Mr. Merriman takes off one week every quarter.

MMA Weekly Reports (includes individual sector weekly reports) are issued once a week, for at least 12 weeks a quarter or 48 weeks a year. Mr. Merriman takes off one week every quarter.

In addition to the schedule above, you may receive a special report, update, or alert pertaining to your subscription report if, in our opinion, market conditions warrant it.

Whenever we put out a special report, update, or alert, there seems to be some confusion as to what subscription services receive these. Generally speaking, the people who subscribe to certain reports get one or a combination of each. You do not get reports or alerts or updates if your subscription does not cover them. So let’s go over the difference.

Special Reports

These are reports of a long-term nature in which we analyze the longer-term outlook of a particular market that we believe is at, or approaching, a critical juncture in its longer-term cycle –a cycle longer than the primary type.

These “Special Reports” are a special feature of the monthly MMA Cycles Report, and are, on average, issued 1-2 times per year. Since they are features of the MMA Cycles Report, they only go to subscribers of the MMA Cycles Report.

When a special report on a given market is being prepared, it will be announced ahead of time in the Free Weekly column, so those who are not subscribers can have the chance to subscribe to it, and receive the special edition when it is issued.

An example would be the MMA Special Stock Market Report that was issued July 28 within the MMA Cycles Report #7. The special report was planned for two weeks, and was announced for two weeks prior to its issuance. It was clearly stated that it was a special report that would go out to subscribers of MMA Cycles Report. Since it was a special report and not an update or alert, it went out ONLY to subscribers of MMA Cycles, which is our monthly subscription report that deals with the longer-term cycle’s analysis.  It was not a report requiring immediate action, which – if it was - would go to weekly and daily traders, who were already advised to short the stock market 1-2 weeks prior to this special report.

MMA Special Updates

These are updates that are written immediately after the market has fulfilled the criteria outlined in either the MMA Cycles Report or a particular weekly report for a primary cycle trough or crest, and which warrants a heightened alert that the trend may be changing now.

The “MMA Special updates” may go to almost everyone, depending on market conditions and type of subscription report. These special updates definitely go to all daily subscribers, full weekly subscribers, and weekly subscribers of that particular sector being covered.

For instance, the “MMA Special Update on Gold” that was issued January 1, 2014 – the day after our criteria was met for the primary (and even longer-term) cycle low in Gold – was sent to all MMA Cycles subscribers, and subscribers of MMA’s Daily, Weekly, and Weekly Gold and Silver reports.

MMA Special Alerts

These “Special Alerts” are sent out only to all MMA Daily subscribers, and sometimes to all Weekly subscribers or those of the particular market we track, depending on whether or not the given indicator pertains to their type of report, and what has been tracked in their report.

As an example, there will be times the weekly report of one market may be short, while in the daily report, it may be long, or preparing to go long. The first signals to go long in the daily report may be elected, but not yet in the weekly. We may send a special alert to the daily people that our buy signals have been met. A day or two later, we may send a similar special alert to the weekly subscribers of that market sector (or full weekly), if there is follow-through to justify a change in trend that the daily subscribers were already alerted to.

I realize everyone would wish to receive all the Special Reports, Special Updates, and Special Alerts that we prepare. But each of these additional services pertain to the type of report one subscribes to. I hope this clarifies the difference, and which report qualifies for which special additional service we provide.
